By accessing or using the Momentzy platform, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not use the service. Continued use after publication of changes constitutes acceptance of those changes.
Description of Service
Momentzy is a digital platform that allows organisers to create events, manage photo albums and share content with guests via a QR code or unique link. The service includes photo uploads, galleries, content moderation, optional face detection and slideshow features.
Eligibility and Requirements
- Be aged 18 or over. Momentzy is not intended for minors.
- Provide a valid email address and accurate, up-to-date information during registration.
- Not hold more than one free account per person or legal entity.
- Fully accept the Privacy Policy and these Terms of Use.
User Obligations
By using Momentzy, you agree to:
- Not upload illegal, offensive, defamatory, pornographic content or content that infringes intellectual property rights or the privacy of third parties.
- Not attempt to access, alter or delete accounts, data or content of other users without express authorisation.
- Not use the service for unauthorised commercial purposes, spam, phishing or any fraudulent activity.
Momentzy reserves the right to remove any content and to suspend or permanently close accounts that violate these obligations, without prior notice.
Content and Licence
By uploading photos or other content to Momentzy, you:
- Declare and warrant that you are the rights holder of the uploaded content or have obtained all necessary authorisations from the respective rights holders.
- Grant Momentzy a worldwide, non-exclusive, royalty-free and sublicensable licence to store, reproduce, display, adapt and use that content in the operation, improvement and promotion of the service, including in marketing and advertising materials.
- The face detection feature is optional and must be activated exclusively by the event organiser. The organiser is the data controller for participants' biometric data and assumes the obligation to obtain the necessary individual consents and comply with applicable legislation.
- Uploading any photo or content implies full acceptance of these Terms of Use and the Privacy Policy.
- Momentzy may, at its sole discretion, moderate, refuse or remove any content that violates these terms or is deemed inappropriate for the platform.
Restrictions on Use
- Reproduce, distribute, sublicense or create derivative works from the service or its code without prior written authorisation from Momentzy.
- Reverse engineer, decompile or attempt to extract the source code of the platform or its APIs.
- Use automated systems, bots, scrapers or other means to access, extract or index data from the service without authorisation.
- Interfere with, disrupt or compromise the security, integrity or performance of the platform or its servers.
Account Management and Deletion
You may delete your account at any time through your account settings. Deletion is permanent and removes all personal data and content associated with the account.
Momentzy may suspend or close accounts that violate these Terms of Use, with or without prior notice, depending on the severity of the infraction.
Payments and Refunds
Momentzy's paid plans are billed monthly or per event (one-time payment), processed securely through Stripe. The free plan requires no credit card.
- Payments are processed securely by Stripe. Momentzy does not store credit card details on its servers.
- Monthly subscriptions can be cancelled at any time from your billing settings. Access to the paid plan remains active until the end of the already-paid billing period.
- Per-event plans (one-time payment) grant permanent access for the purchased event duration, with no automatic renewal.
- We offer a 30-day money-back guarantee for plans where the event has not yet taken place and no guest photos have been uploaded. If you purchase a plan and decide not to proceed before the event starts, you may request a full refund within 30 days of purchase.
- Once the event takes place (guest photo uploads begin) or photos are downloaded, the service is considered rendered and no refund applies — even if fewer than 30 days have passed since purchase. This applies regardless of plan duration or purchase date, except where required by applicable consumer protection legislation.

Limitation of Liability
Momentzy does not guarantee uninterrupted or error-free availability of the service. We are not liable for data loss, indirect, incidental damages or lost profits arising from the use or inability to use the platform. Momentzy's maximum liability to you is limited to the total amount paid in the 12 months preceding the event giving rise to the claim.
